1) Introductory provisions
By accessing and using the mStart website the Users confirm that they have read, understood and agreed to the Statement on privacy and confidentiality of data (hereinafter: Privacy Statement) as well as terms and conditions conditions of using the mStart website. The Users which do not accept these terms and conditions in full, should leave the mStart website immediately and refrain from using it again.
2) Privacy Statement Revision
mStart is authorized to modify the Privacy Statement at any time by posting a revised text on the mStart website. Such changes and/or modifications shall become effective immediately upon the posting thereof on the website. Any use of the website by the End User after such notice shall be deemed to constitute acceptance by the End User of such modifications.
The User is obliged to periodically review our Privacy Statement to become and remain familiar with it. The User will be deemed to have accepted any modifications to the Privacy Statement if they continue to use the website after they have been posted. We will not be liable for any damage caused to the users, registered users or third parties due to such changes.
3) Type and Use of Collected Information
mStart collects personal information that identifies website Users. When the User participates in certain activities on the mStart website, such as opening an account, subscribing to a newsletter, posting content and/or publishing articles on forums, participating in contests organized by mStart, filling out a survey, posting comments, sending feedback to mStart, searching for information about mStart products and services and posting videos, mStart may require the User to provide certain personal information. The User is not required to engage in these activities. If the User decides to engage, mStart is authorized to ask for personal information: first and last name, address (including postal code), email address, phone number, date of birth and a photo.
mStart is authorized to use such personal information to offer you products and services, organize contests, enhance website functionality, improve advertising and promotional efforts, analyze website usage, improve the offer of mStart products and services and to gather your experiences with third parties. mStart is explicitly authorized to use comments from Users in order to notify other users about their products and services. Such comments can be published in mStart advertising materials on the website. Further, if you are using mStart website to send information or products to other persons, mStart is authorized to save personal information from the User and recipient. mStart is authorized to use personal information of the User for troubleshooting problems, executing administrative tasks, establishing contacts, honoring agreements, including the Terms and Conditions of Use and the Privacy Statement of the mStart website, complying with relevant laws and cooperating with law enforcement services.
mStart is authorized to collect information that does not identify a specific End User, including the Uniform Resource Locator (URL) of the website the User visited before coming to the mStart website, URL of the website which the User visited after leaving the mStart website, type of browser the User is using and the Internet Protocol (IP) address of the User. Depending upon the activity, some information is identified as mandatory, and some as voluntary. If the User does not provide the mandatory data with respect to a particular activity, they may not be able to engage in that activity. mStart will not collect personal information via its website, (e.g. first and last name, address, phone number or email address), unless the User voluntarily chooses to provide us with it (e.g. by registration, survey), respectively, provides their consent, or unless otherwise permitted by applicable laws and regulations for the protection of personal data.
4) Disclosure of Personal Information
mStart will not share Personally Identifiable Information with other parties, but may share information about Users with mStart Group subsidiaries.
mStart provides certain services and products through third parties. These “Third Party Service Providers” perform different functions on behalf of mStart such as sending administrative and promotional emails. mStart may share the User’s personal information with such Service Providers to fulfill orders, deliver packages, send mail and emails, administer contest, remove repetitive information from customer lists, analyze data, provide marketing assistance, provide search results and links, process credit card payments, operate the website, troubleshoot and provide customer service.
mStart is authorized to disclose information about the User in order to protect mStart and others. mStart is authorized to disclose Personally Identifiable Information of the User when it is justified to expect that the disclosure will help in law enforcement or is ordered by the court, to ensure compliance with this Privacy Statement, the Terms and Conditions of Use of the mStart website or other agreements; or to protect property rights or safety of this website, its Users or others.
If the User chooses not to have their personal data used to support mStart’s relationship with business partners and clients (especially direct marketing or market research), mStart will respect the User’s choice. mStart does not sell or otherwise market Personally Identifiable Information to third parties, except to mStart’s affiliates.
5) Updating and Correcting Information
The User is authorized to change any personal information by sending an email message or changing the profile. The email message must specify the User’s first and last name, address and email address, and information that are to be updated. The User can always request to have the information about their account permanently deleted or removed. The User is informed that mStart cannot delete information associated with past transactions on the mStart website.
6) Data Protection
mStart uses technical and organizational security measures to protect personal data against accidental or unlawful destruction, loss or alteration and against unauthorized disclosure or access.
The User can access personal information on mStart website using password and email address. The User is advised not to disclose any passwords to a third party. mStart is authorized to store cookies with the User’s information on the computer. They are used for saving the User’s time when returning to the mStart website, monitoring and directing the User’s interest to provide services customized to fit the needs of every User. Cookies also collect non-personal information from visitors. mStart uses third-party advertising companies to serve ads on mStart website. As part of their service, they may place separate cookies on your computer. mStart has no access to, or control over these cookies. This Privacy Statement applies only to the use and disclosure of information mStart collects from the Users. Other websites which can be accessed via mStart website have their own statements on confidentiality and data collection and their use and disclosure of such information. mStart is not responsible for the operation or for the content, privacy policies, or security of, third party sites.
Minors may participate in promotional activities, only and exclusively with the consent from their parents, guardians or custodians. mStart will not knowingly collect or keep information – personal data from children under the age of 14, without insisting that they seek prior parental consent if required by applicable law. mStart will only use or disclose personal data of children to the extent permitted by law, to seek parental consent pursuant to local law and regulations or to protect a child.
10) Privacy Statement Application
This Privacy Statement shall be effective from 1 May 2015 until revocation by mStart.
